General Terms and Conditions Meeting & Events b_smart selection

1. Cancellation of Banquets / Catering
In the event of a cancellation, each establishment of b_smart selection reserves the right to charge the following cancellation fees – the cancellation fee includes all agreed-upon services – unless otherwise agreed in writing between the parties:

Cancellation Days for Events
Payment obligation of the minimum turnover or the booked service (room rental, menu, drinks, etc.)

• 60 days = Free of charge

• 59 – 30 days = 30 %

• 29 – 11 days = 18 days 50 %

• 10 – 4 days = 6 days 80 %

• 3 – 0 days = 100 %

1.1 Special Cancellation Regulation
When booking the ballroom from May to September inclusive, and in December:

• On Saturdays: Cancellation costs of CHF 5,000.00 from 9 months before the event

• On Fridays: Cancellation costs of CHF 3,000.00 from 6 months before the event

1.2. Reduction in the Number of Persons
If the number of participants or guests is reduced by more than 20% compared to the reservation confirmation, the following costs will be charged for each non-attending participant:

• Up to 11 days before the event: Free of charge

• 10-5 days before the event: 50% of the agreed services

• 4 days or less before the event: 100% of the agreed services

1.3. Payment Conditions
After issuing the order confirmation, we reserve the right to invoice you for 50% of the amount (advance invoice) of the confirmation as a down payment. After the event has taken place, you will receive a detailed final invoice.

The organizer is liable for any unpaid invoices from participants.

The establishment is unable to send invoices outside of Switzerland and Liechtenstein. Guests from abroad are requested to make the payment in advance by bank transfer or to settle the final amount with a credit card. Alternatively, the amount to be paid must be reserved on the customer's credit card as a guarantee before the start of the event.

1.4. Changes in the Number of Persons for Banquets & Seminars
The customer undertakes to inform us in writing of the final number of participants as early as possible, but no later than two working days before the event date. After this deadline, the b_smart selection establishment reserves the right to charge for the originally reported number of persons.

If the actual number of participants is lower, the number of persons reported up to 48 hours (two working days) before the event is binding for invoicing.

If the number of participants is subsequently increased, billing will be based on the actual number of participants.

2. Cancellation of Seminars / Events
All cancellations by the customer must be made in writing. The b_smart selection establishments reserve the right to charge the following hotel expenses as follows:

• Up to 61 days before the event = Free of charge

• 60 to 15 days before the event = 60% of the package

• 15 to 4 days before the event = 80% of the package

• 3 to 0 days before the event = 100% of the package

The package is understood as the agreed service (rooms, infrastructure, catering, accommodation, etc.) including hotel rooms multiplied by the number of persons stated in the reservation confirmation, or for hotel rooms: Room package x number of persons x days.

Any advance services already rendered by the hotel must be paid for in full in any case. If an equivalent substitute organizer, acceptable to the hotel, can be found for the reserved rooms, the organizer will be released from the cancellation costs.

The hotel reserves the right to adapt the cancellation conditions individually depending on the type and size of the event. In this case, this will be noted in the confirmation.

2.1. Changes in the Number of Persons for Day Seminars
For a day seminar, changes to the booked number of participants must be communicated to the hotel in writing no later than three working days before the start of the event. The definitively reported number of persons is also binding for the invoice. The provisions of point 1.1. apply accordingly.

2.2. Services
The specific services of the hotel are based on the reservation confirmation. Furthermore, for all cancellations, any advance services provided by the establishments of bsmart selection AG and its partners must be paid for in full in any case.

If the guest requests services that are not provided by the hotel, the hotel acts merely as an intermediary. These services will be invoiced separately.

2.3. Room Change
In the event of fundamental changes in the number of guests, the contractor reserves the right to move the event to a different room/area. The contractor will inform the partner collaboratively but is not obliged to provide an account.

3. Extension / Permit
The event will be held until midnight at the latest without a special permit. If it is planned to extend the event, a special permit must be obtained. The organizer is obliged to approach the establishment about this in good time. The establishment will assist in obtaining the permit. The resulting costs shall be borne in full by the organizer.

Should complaints or demands for repayment from other guests arise due to any noise disturbances, the establishment reserves the right to charge these to the organizer.

3. Liability
Theft and damage to items brought in by the organizer, event participants, or third parties are excluded from liability. The insurance of exhibition objects as well as other items brought in by the organizer, event participants, or third parties is the responsibility of the organizer.

The establishment is not liable if fire safety regulations are not complied with (for example, maximum number of persons, etc.) and is entitled to withdraw from the contract without compensation.

4. Copyright
Newspaper advertisements and other advertising in the broader sense – also in parts or in revised form – with reference to events are only permitted with prior express written approval.

5. Withdrawal by b_smart selection
If the contractor has reason to believe that the event threatens to jeopardize the smooth operation, security, or reputation of the establishment, the contractor is entitled to cancel the event without compensation.
