General Terms and Conditions b_smart selection

1. Scope of Application, Contractual Partner, and Conclusion of Contract

These terms and conditions apply to contracts for the rental of rooms for accommodation, as well as for all related further services provided by b_smart selection and its establishments (hereinafter referred to as "b_smart"), represented by bsmart selection AG, Industriestrasse 2, 9487 Gamprin-Bendern.

The following establishments belong to b_smart selection:

  • b_smart motel Basel (bsmart motel Bas GmbH)

  • b_smart motel Landquart (bsmart motel Lan GmbH)

  • Hotel Vaduzerhof Vaduz (Hotel Vaduzerhof Anstalt)

  • Hotel Rebstock by b_smart Wolhusen (Rebstock Hospitality AG)

  • Motel Rheinfels Park Stein (Rheinfelspark Hospitality GmbH)

  • Hotel Storchen Schönenwerd (Storchen Hospitality AG)

The contractual partners are b_smart and the guest. If a third party has booked one or more rooms for the guest, this third party is liable to b_smart together with the guest as joint and several debtors for all obligations arising from the concluded contracts. In this case, the guest and the third party are jointly and severally liable.

A contract is concluded when payment of the total booking amount is made with a credit or Maestro card during online booking or direct booking at the check-in terminal. b_smart will send an electronic booking confirmation to the guest. Subletting or other transfer of the rented rooms to third parties, as well as their use for purposes other than accommodation, require the prior written consent of b_smart.

By concluding the contract, the contractual partner acquires the right to the customary use of the rented rooms and the facilities of the b_smart selection establishments that are usually accessible to guests without special conditions. Guests are aware that staff at the b_smart selection establishments is available on a very limited basis, and the guest must exercise self-responsibility.

The contractual partner must exercise their rights in accordance with the house rules.

2. Booking and Cancellation

Booking is done online or at the check-in terminal. Prepayment of the entire booking amount is made by credit or Maestro card.

The contractual partner does not acquire a claim to the provision of specific rooms unless explicitly agreed.

After the contract has been concluded, the guest can cancel the contract up to 7 days before the booked date. If a free right of cancellation outside the applicable 7-day period has been agreed in writing with the guest by special arrangement, the guest can cancel the contract free of charge up to that point. The right of cancellation expires if the guest does not exercise it in writing to b_smart by the agreed date. If no free right of cancellation outside the applicable 7-day period has been agreed in writing, b_smart is entitled, in the event of the guest's cancellation, to charge the agreed prices and debit them from their credit card, unless the guest's cancellation is due to circumstances for which b_smart is responsible. b_smart recommends taking out travel cancellation insurance in any case.

If a free right of cancellation for the guest within a specific period has been agreed in writing, b_smart, for its part, is entitled to cancel the contract during this period if there are inquiries from other guests for the contractually booked rooms and the guest, upon inquiry by b_smart, does not waive their right to cancel.

Furthermore, b_smart is entitled to withdraw from the contract extraordinarily, for example, if:

  • force majeure or other circumstances beyond b_smart's control make performance of the contract impossible;

  • rooms are booked with misleading or false statements of material facts, e.g., regarding the person of the guest or the purpose of the stay;

  • b_smart has justified reason to believe that the use of the establishment's services may jeopardize the smooth operation, security, or reputation of the establishments in public, without this being attributable to b_smart's sphere of control or organization;

  • there is a violation of point 1, second paragraph of these GTCs;

  • the guest makes considerably detrimental use of the premises or, through their inconsiderate, offensive, or otherwise grossly improper behavior, makes cohabitation unpleasant for other guests, the owner, their staff, or third parties residing in the accommodation establishment, or is guilty of an act punishable by law against property, morality, or physical safety towards these persons;

  • the guest contracts a contagious illness or an illness that extends beyond the duration of the stay, or otherwise requires nursing care;

  • the stay is unlawful.

In the event of cancellation by b_smart for the above-mentioned reasons, the guest has no claim for damages.

3. Check-in and Check-out

Check-in is done via the designated terminal. The guest receives the room key card directly from the terminal after completing check-in. The room key card must be deposited in the designated box when leaving the b_smart establishments. The room is available from 2:00 PM at the latest on the day of arrival. On the agreed day of departure, rooms must be vacated by 11:00 AM at the latest. b_smart is entitled to charge for an additional day if the rented rooms are not vacated on time. If a room is occupied before 7:00 AM, the preceding night counts as the first overnight stay.

4. Prices and Payment Methods

All prices listed in price lists, on websites, or elsewhere are in Swiss Francs (CHF) and include statutory value-added tax (VAT). Prices result from the contract conclusion or the underlying price list. Booking changes entitle b_smart to charge different prices, e.g., for changes in the number of booked rooms or the length of stay of the guests.

The following payment methods or credit cards are accepted:

  • Visa

  • Mastercard

  • Maestro card

b_smart does not have a staffed reception; therefore, payment by cash or check is not possible.

5. Smoking Ban and Fire Protection

The following fire safety regulations must be observed throughout the entire building of all b_smart establishments. Only items and devices belonging to the room's furnishings may be used.

The use of kettles, ovens, toasters, immersion heaters, electric irons, and similar devices is prohibited.

If an attempt is made to willfully disable the smoke detectors, a penalty fee of at least CHF 1,000.00 per room will be charged. Furthermore, the guest will be charged for all other consequential costs arising therefrom.

In accordance with the Act of December 13, 2007, on Non-Smoker Protection and Advertising, smoking is prohibited indoors at b_smart establishments.

In the event of an erroneous or abusive activation of the fire alarm, a fee of at least CHF 1,000.00 plus the deployment costs of the fire department will be charged to the person responsible.

6. Children

Baby cots must be reserved by email 24 hours before arrival. Prices according to the price list.

7. Pets

Bringing a pet requires the consent of b_smart. The guest is obliged to announce the wish to bring a pet in advance. If b_smart consents to bringing the pet, this is on the condition that the pet is under the constant supervision of the guest, is free from diseases, and otherwise poses no danger to hotel guests and staff. Bringing the animal to breakfast or the bar of the b_smart hotel is not permitted. A fee of CHF 25.00 per night applies for the pet and requires bringing your own dog basket or dog blanket.

Pets are not allowed in any b_smart motels.

Exceptions are guide dogs for the blind, hearing dogs, and other comparable service dogs. These may be brought free of charge and at any time.

8. Parking Spaces

Some free parking spaces are available to guests. b_smart assumes no liability for parking damage, theft, or other damage to the vehicle during the guest's stay. For fire safety reasons, illegally parked vehicles may be towed at the vehicle owner's expense.

9. Services

Various snacks, drinks, and hygiene articles are available to the guest for purchase. Breakfast and various drinks such as coffee, tea, juice, and water are included in the room rate.

10. Facilities

b_smart offers the following facilities: High-speed Wi-Fi in all establishments, some free parking spaces, high-quality equipped non-smoking rooms, automatic room ventilation, flatscreen TV with satellite/TV/radio, alarm clock, international television channels, safe, rooms that can be completely blacked out, large desk.

11. Fitness and Wellness (Not available in every establishment)

In some establishments, b_smart provides guests with a small wellness and fitness area. The equipment is in good condition. Use of the equipment is at your own risk and without supervision. b_smart disclaims all liability. Sport and wellness should serve for relaxation. Guests with impaired health or excessive fatigue should refrain from use.

12. Liability

b_smart is liable for items brought in by guests in accordance with statutory provisions. b_smart's liability only applies if the items have been handed over to b_smart or persons authorized by b_smart, or brought to a place designated or specified by them.

Liability for slight negligence is expressly excluded. Should the guest suffer damage or not be satisfied with b_smart's services, they must report this to b_smart immediately; otherwise, no rights can be asserted.

All claims against b_smart expire six months after the guest's departure, unless mandatory statutory provisions stipulate longer periods.

If the contractual partner is an entrepreneur, liability for gross negligence is also excluded.

13. Internet

b_smart provides free internet access via Wi-Fi.

b_smart assumes no liability for malfunctions of the internet, damage by third parties, imported data of any kind (viruses, worms, Trojan horses, etc.), as well as for links from and to other websites. b_smart has no control over the content and form of external websites.

b_smart cannot guarantee the error-free functioning of hardware and software. b_smart would like to point out that this page may contain technical inaccuracies or typographical errors.

In no event shall b_smart be liable to the guest or any third party for any direct, indirect, special, or other consequential damages arising from the use of this website or any website linked to it. Also excluded is any liability for lost profits, business interruption, loss of programs or other data in the guest's information systems. This also applies even if the possibility of such damages is expressly pointed out.

14. Data Protection

b_smart undertakes to maintain the confidentiality of the guest's personal data. b_smart provides the guest with content or services from other websites through links on this page. These pages are not subject to b_smart's data protection guidelines.

It is recommended to review each of these pages and determine how data is protected in each case. The guest provides b_smart with personal data for communication or reservation purposes. b_smart reserves the right to use these for marketing purposes. Confidentiality of emails and other electronic means of communication is not guaranteed.

15. Final Provisions

All information (especially prices, reservations, online calculations) is without guarantee. b_smart cannot guarantee that this data is complete and up-to-date at all times. b_smart reserves the right to change or update the information on this page at any time without prior notice. This also applies to improvements and/or changes to the products described on this page.

Changes or additions to the contract and the reservation confirmation shall, whenever possible, always be made in writing and announced on the website www.b-smarts.net. Unilateral changes or additions are ineffective. By paying for the booking, the guest accepts the General Terms and Conditions.

This contract and all disputes arising therefrom shall be governed exclusively by Liechtenstein law.

The place of jurisdiction is the registered office of b_smart or the ordinary place of jurisdiction of the defendant.
